Section 1: Acknowledgment of Risks
I, the undersigned client, acknowledge that I am participating in a trip with African Shark Eco-Charters (ASEC) and that while ASEC takes reasonable precautions to ensure safety, certain inherent risks are associated with boat trips, shark viewing, and related activities. These risks include but are not limited to, personal injury, property damage, or fatality due to ocean conditions, boat capsizing, collisions, and accidents while boarding or in the shark cage. I accept responsibility for my well-being and confirm that I have the necessary swimming skills to participate. I also acknowledge that ASEC is not responsible for seasickness and recommend taking necessary precautions.

Section 2: Liability Disclaimer
ASEC acts solely as an agent for arranging trips, accommodations, and transportation services. It assumes no liability for damages, injuries, or losses related to these services. Participants are encouraged to obtain personal medical insurance and acknowledge that they are responsible for any emergency evacuation costs. ASEC is not liable for the safety of personal property left in vehicles during the trip.

Section 3: Media Release
I consent to ASEC employees and guests photographing or filming during the trip, with the understanding that these images may be used for promotional purposes without compensation.

Section 4: Shark Sightings
I recognize that sightings of sharks cannot be guaranteed, and no refunds will be issued for non-sightings.

Section 5: Credit Card Policy Please note: As of October 1, 2023, any refunds processed will be minus the bank’s transaction fees. By signing this form, I acknowledge awareness of these charges. 

Section 6: Cancellation Policy

I understand that failure to confirm my trip with ASEC the day before may result in a full charge for a “no show.” 

Cancellation Fees

For Exclusive Hire & Groups of 5 or More:
30 days or more before the start date: 75% cancellation fee
15 days or fewer before the start date: 100% cancellation fee

For Individuals & Groups of Fewer Than 4:
Less than 7 days before the start date: 75% cancellation fee
48 hours or fewer before the start date: 100% cancellation fee
